Veterans Affairs Reimposes Near-Total Abortion Ban for Service Members

The Department of Veterans Affairs has reinstated a near-total ban on abortions within its medical benefits package, reversing a 2022 Biden-era expansion that allowed procedures in cases of rape, incest, or health risks. A Department of Justice Office of Legal Counsel memo concluded that the broader policy violated longstanding federal restrictions on funding abortions through VA services.

The reversal took effect immediately following the memo’s release.

VA officials stated the change aligns with congressional limits, permitting abortions only when a physician certifies the mother’s life is endangered. Care for miscarriages, ectopic pregnancies, and other non-elective conditions remains available. The policy applies uniformly nationwide, unaffected by varying state laws post-Dobbs decision.

OLC Deputy Assistant Attorney General Joshua Craddock wrote that while the secretary of Veterans Affairs has wide latitude over what types of medical services it offers to the millions of veterans under its purview, “that discretion is not limitless.” The Veterans Health Care Act “makes clear” that the VA is restricted to providing abortion services only when a pregnancy carries certain types of risks, Craddock wrote.

“That language is unambiguous,” Craddock said. A footnote noted that the only exceptions consistent with the law were abortions for “life-threatening circumstances, including treatment for ectopic pregnancies or miscarriages.”

Asked about whether the VA was providing abortions, press secretary Peter Kasperowicz told Fox News Digital it was not, attributing the halt to the DOJ’s new interpretation of the law.

“The DOJ’s opinion states that VA is not legally authorized to provide abortions, and VA is complying with it immediately,” Kasperowicz said, noting that the DOJ’s opinion was consistent with a new Trump administration rule proposal that was still going through the regulatory process.

Critics, including veterans advocacy groups and Democratic lawmakers, argue the restriction burdens women veterans, especially survivors of military sexual trauma who may face barriers in restrictive states. Pro-life organizations praised the move as upholding taxpayer protections and federal consistency across programs like Medicaid and TRICARE.



The Biden administration had expanded access in response to state bans following the Supreme Court’s overturn of Roe v. Wade, allowing VA facilities to provide services even where prohibited locally. The Trump administration’s DOJ review deemed this overreach, emphasizing VA authority does not extend to elective procedures.

This shift affects millions of veterans and dependents relying on VA healthcare. Internal guidance directs providers to comply, with exceptions strictly limited. Veterans in states with bans now face additional challenges accessing broader services outside VA systems.

The decision reinforces federal prohibitions dating back decades, reflecting ongoing debates over reproductive care in government-funded programs. Supporters view it as correcting an unauthorized expansion, while opponents highlight impacts on vulnerable service members.
