Captain of Capsized Boat That Killed a Mom and Her Baby Was an Illegal Alien

A five-month-old girl went into New York Harbor without a life jacket. Her mother went in holding her. Both came out dead. The man at the wheel had no captain’s license, too many bodies on a 21-foot boat, and no legal right to stand on American soil.

His name is Manuel Ernesto Hernandez-Umana. He is 46. He is from El Salvador. On August 8 he took a Yamaha AR210 out near Liberty Island for a birthday cruise, packed 14 people onto a vessel built for 10, and then tried to punch through a swell. The bow went under. The boat flipped. Sara Sanchez, 27, of College Point, Queens, and her infant daughter Antonella Garcia never came back.

Federal authorities now say the “captain” was an illegal alien who had been living here since 2007. That is not a clerical footnote. That is the whole story.

He Lied at the Border and Stayed for 19 Years

Hernandez-Umana entered through Texas after telling a Customs and Border Protection officer he was a United States citizen. He was not. He stayed anyway.

He drove limousines. He worked for a tour outfit. Then he started running unlicensed harbor trips, including on a friend’s boat he had not registered and was not certified to operate with paying customers.

That is what sanctuary culture produces. A man who commits fraud at the border gets a job, a boat, and a night on the water with a baby in his care. No Coast Guard ticket. No infant flotation devices on board. According to the complaint, he told passengers they did not even need life jackets. The parents wore theirs. The five-month-old did not.

The baby’s father, Andres Garcia, survived. So did Hernandez-Umana. Twelve people were pulled from the harbor by other charter crews, the NYPD, the FDNY, and the Coast Guard. Two were already gone.

This criminal illegal alien was illegally and recklessly conducting unlicensed boat tours in New York Harbor when his boat capsized, killing a 27-year-old woman and her 5-month-old baby. Thanks to the hard work of the men and women of the Coast Guard, ICE, and our federal, state, and local partners, this criminal is off our streets and out of our waterways. Once he faces justice for his crimes, we will make sure that he is swiftly removed from our country.

That was DHS Secretary Markwayne Mullin. He is right. The removal should have happened in 2007.

Negligence With a Badge of Impunity

Prosecutors charged him with two counts of misconduct and neglect of a ship officer resulting in death. NYPD Commissioner Jessica Tisch said he showed “a complete disregard for the safety of his passengers.”

A federal judge then let him walk on $50,000 bail. Only after the Coast Guard Investigative Service confirmed what should have been obvious — that he was unlawfully present — did ICE take him into custody.

The New York Post and Fox News reported the sequence. First the tragedy. Then the paperwork. Then, at last, the immigration hold. A mother and a baby are in the ground. The man who put them in the water is only now being treated like what he has been for nearly two decades.

That innocent blood be not shed in thy land, which the LORD thy God giveth thee for an inheritance, and so blood be upon thee.

A nation that will not ask a simple question at the border — who are you, and why are you here — will eventually answer a harder one in a hospital morgue. Who let this man take a baby onto an overloaded boat in the dark?

The Statue of Liberty stood a few hundred yards away while that question was being written in salt water. Open borders did not give Antonella Garcia a better life. They gave an unlicensed illegal alien a tiller and a party of 14. The rest is grief, charges, and a deportation that should have come before the first swell ever hit the bow.
