Appeals Court Blocks Activist Judge’s Order That Hamstrung ICE Agents in Chicago

A federal appeals court has stepped in to halt restrictions on immigration agents operating in the Chicago area, delivering a much-needed check on judicial overreach amid a major enforcement push that’s already netted over 3,000 arrests since September.

The Seventh Circuit panel issued the stay against U.S. District Judge Sara Ellis’ preliminary injunction, which had barred agents from deploying physical force or chemical agents like tear gas and pepper balls except in cases of “an immediate threat.” The appeals court described the order as “overbroad” and “too prescriptive,” noting it “resembles a federal regulation” by micromanaging riot control tools.

This operation, led initially by Border Patrol commander Gregory Bovino with about 230 officers from U.S. Customs and Border Protection, has faced backlash from media outlets and activists claiming excessive force. Witnesses described incidents where they were tear-gassed, shot with pepper balls while praying, and had guns pointed at them. Judge Ellis went so far as to deem Trump administration witnesses, including Bovino, “simply not credible.”

Yet the Justice Department pushed back hard, arguing the restrictions could “subvert” the constitutional structure and hamstring law enforcement’s ability to do its job. DHS spokeswoman Tricia McLaughlin praised the appeals court’s move as “a win for the rule of law and for the safety of every law enforcement officer.”

The crackdown hasn’t been without broader scrutiny. Multiple lawsuits have emerged, including allegations of poor conditions at a Chicago-area ICE facility, which prompted a recent visit by a federal judge and attorneys. As agents prepare for their next deployment to New Orleans, questions linger about whether these legal challenges are part of a coordinated effort to undermine border security from within liberal strongholds.

Recent reports from outlets like CNN and Courthouse News confirm the appeals court’s decision was issued just today, emphasizing its temporary nature while hinting at a fast-tracked appeal for a more balanced ruling. In the meantime, this stay ensures agents can continue protecting communities without unnecessary handcuffs.
